Terms and Conditions
Effective: September 24, 2026 · Last updated: September 24, 2026
These Terms and Conditions ("Terms") are an agreement between you and RealClientAI LLC ("we", "us", "our"). They cover the HitchBalance app for iPhone and Android, the web version at hitchbalance.app, and the website hitchbalance.com (together, "HitchBalance"). You accept these Terms when you tap "I agree" the first time you open HitchBalance, and again each time you keep using it after we update them. By installing or using HitchBalance you agree to these Terms and to our Privacy Policy. If you do not agree, do not use HitchBalance.
1. Who can use HitchBalance
You must be old enough to form a binding contract where you live, or have your parent or guardian's permission. HitchBalance is not directed to children under 13.
2. What HitchBalance is
HitchBalance is a personal planning tool. It shows your work schedule and days off on a calendar and, based only on the rules and numbers you enter, estimates PTO balances and pay. It has no accounts and no server; everything you enter stays on your device, as described in the Privacy Policy. We may add, change or remove features in updates.
3. Your license
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use HitchBalance on devices you own or control, for your own personal use, under these Terms and the rules of the store you got it from. You may not copy, sell, rent, lend or sublicense HitchBalance; modify, reverse engineer or decompile it, except where the law allows this despite these Terms; remove any notice in it; use it to build a competing product; or use automated tools to access the website. All rights not granted stay with us.
4. Purchases
Lite, Pro and Partner Pass are one-time in-app purchases made through the Apple App Store, Google Play or Samsung Galaxy Store. The store processes your payment under its own terms; we do not see or store your payment details. Prices are shown in U.S. dollars and may differ in your country; the store adds any tax. Refunds are handled by the store you bought from under that store's policy; we cannot issue refunds for store purchases. Purchases are tied to the store account you bought with and can be restored on that account's devices through the store's restore function. Nothing is sold on the website. Prices and features may change; a change does not affect a purchase you already made.
5. Your data and backups
HitchBalance keeps your data on your device only. You are responsible for backing it up (Settings → Backup) and for the files you export. If you delete the app or reset it, your data is gone and we cannot recover it. If you share a Partner snapshot, you are responsible for choosing who receives it; the recipient controls the copy on their phone.
6. Estimates, not advice
All PTO, pay, overtime, differential, per diem, expense, tax-withholding and forecast figures in HitchBalance are estimates calculated from the rules, rates and numbers you enter. They can differ from what your employer, payroll provider or tax authority calculates. HitchBalance is not tax, legal, financial, accounting or HR advice, and it is not affiliated with, endorsed by, or a substitute for your employer, union, payroll provider or a professional adviser. Check figures against your pay stub and your employer's policies before relying on them. You are responsible for the values you enter and for every decision you make using HitchBalance. You use HitchBalance at your own risk.
7. Acceptable use
Do not use HitchBalance to break the law, to infringe anyone's rights, to attack, overload or probe the website, or to send spam or harmful content through the support form. We may block access by anyone who does.
8. Ownership and feedback
HitchBalance, its code, design, text, graphics, and the HitchBalance name and mark belong to RealClientAI LLC and are protected by copyright and trademark law. Your schedule and everything you enter remain yours. If you send us suggestions or feedback, you agree that we may use them without payment or obligation to you.
9. App stores and third-party terms
Your use of the App Store, Google Play or Galaxy Store, and of any other third-party service you use alongside HitchBalance, is governed by that party's terms, which apply in addition to these Terms.
10. Additional terms for the App Store version
If you obtained HitchBalance from the Apple App Store, the following also apply:
- (a) These Terms are between you and RealClientAI LLC only, not Apple. RealClientAI LLC, not Apple, is solely responsible for HitchBalance and its content.
- (b) Your license is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except that HitchBalance may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- (c) RealClientAI LLC, not Apple, is solely responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for HitchBalance.
- (d) RealClientAI LLC is solely responsible for any product warranty, whether express or implied by law, to the extent not disclaimed. If HitchBalance fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price you paid for HitchBalance; to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to the failure to conform to a warranty are RealClientAI LLC's responsibility.
- (e) RealClientAI LLC, not Apple, is responsible for addressing any claim by you or a third party relating to HitchBalance or your possession or use of it, including product liability claims, any claim that HitchBalance fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- (f) If a third party claims that HitchBalance or your possession and use of it infringes that third party's intellectual property rights, RealClientAI LLC, not Apple, is solely responsible for the investigation, defense, settlement and discharge of the claim.
- (g) You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- (h) You must comply with applicable third-party terms when using HitchBalance.
- (i) Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
- (j) Questions, complaints or claims about HitchBalance go to RealClientAI LLC at support@hitchbalance.com.
11. Disclaimer of warranties
HitchBalance is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that HitchBalance will be error-free or uninterrupted, or that its estimates will match any employer's or authority's figures. Some places do not allow disclaimers of implied warranties, so parts of this section may not apply to you.
12. Limitation of liability
RealClientAI LLC is not responsible or liable for the way you use HitchBalance, for any decision you make or action you take based on it, or for any loss that results, including a missed or mis-scheduled shift, a pay or leave shortfall, tax under-withholding or penalties, or lost data. To the fullest extent the law allows, RealClientAI LLC and its owners, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost pay, lost time off, lost data, lost profits or lost savings, arising from or related to HitchBalance, even if we were told they were possible. Our total liability for all claims relating to HitchBalance is limited to the greater of the amount you paid for HitchBalance in the 12 months before the claim or ten U.S. dollars (US$10). Some places do not allow these limits, so parts of this section may not apply to you.
13. Your responsibility to us
You agree to cover our costs, including reasonable attorney fees, for claims by others that are caused by your breach of these Terms or your misuse of HitchBalance.
14. Ending these Terms
You may end these Terms at any time by deleting HitchBalance. We may end them if you break them. Sections 6, 8 and 10 through 17 survive the end of these Terms.
15. Changes to these Terms
We may update these Terms. We post the new version here with a new "Last updated" date and note material changes in the app's release notes. Using HitchBalance after a change means you accept the new Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict-of-law rules, and by U.S. federal law where it applies. Before starting any legal action, contact us at support@hitchbalance.com so we can try to resolve the matter. Any dispute that is not resolved will be brought in the state or federal courts located in Louisiana, and you consent to their jurisdiction, except that either side may bring an eligible claim in small-claims court. Nothing in this section takes away consumer rights you have under the law of the place where you live.
17. General
These Terms and the Privacy Policy are the whole agreement between you and us about HitchBalance. If any part is unenforceable, the rest stays in force. If we do not enforce a term, we may still enforce it later. You may not transfer these Terms; we may transfer them to a successor of our business. You will comply with U.S. export laws when using HitchBalance.
